Unreserved Chinese EB-5 investors move forward in July Visa Bulletin

The July 2026 Visa Bulletin marks a positive development for Mainland Chinese EB-5 investors. The Final Action Date has moved up by 70 days to Dec. 1, 2016.

This change means that Chinese investors in the Unreserved category with priority dates on or before this date can have their green card applications approved and issued.  This advancement not only helps families move forward in their careers but also protects dependent children from aging out.

The Unreserved category includes EB-5 petitions submitted before the 2022 EB-5 Reform and Integrity Act, as well as those for projects outside of Targeted Employment Areas (TEAs).

On the other hand, the Date for filing for Chinese Unreserved investors remains unchanged at March 1, 2017. This allows applicants with priority dates up to that calendar day to submit their Adjustment of Status paperwork early, enabling them to receive essential interim benefits, such as work permits and travel authorization, while they wait for their green cards.

Unreserved India remains capped

For Indian EB-5 investors, the Final Action Date is now unavailable, meaning no new green card approvals will be issued until the new fiscal year begins. 

“Due to high demand and number use by aliens chargeable to India in the EB-5 unreserved visa category, India’s pro-rated EB-5 unreserved limit was reached, and the category is unavailable for the remainder of [fiscal year] FY 2026,” said the Department of State (DOS) in a notice in the July visa bulletin.

DOS also said that the Indian final action date may advance depending on demand from Indian applicants for EB-5 unreserved numbers and the FY 2027 limit on employment-based visas.

Meanwhile, the Indian filing date in the Unreserved category remains May 1, 2024. The filing and final action dates for other countries remain current.

These updates highlight the importance of EB-5 applicants staying informed about this monthly bulletin, which serves as a roadmap for when they can finally get a green card.
