The November Visa Bulletin maintains final action and filing dates for EB-5 investors

The U.S. Department of State (DOS) released the November 2023 visa bulletin, with no changes since last month’s bulletin, which introduced major changes to final action dates and dates for filing applications for EB-5 investors.

As of November, EB-5 investors from countries other than mainland China and India face no backlog issues as the final action dates for their applications remain current.

The final action date for EB-5 green card applications for Chinese investors is Oct. 1, 2015. Meanwhile, this date for Indian EB-5 investors is Apr. 1, 2017, for the second month.

All the while, the dates for filing an EB-5 petition for investors continue to be Jan. 1, 2017, and Apr. 1, 2022, for Chinese and Indian EB-5 applicants, respectively. The dates for filing for other countries in the rural, high unemployment, and infrastructure set-aside categories remain current.

The DOS also informed that the fiscal year 2024 limit for annual employment-based preference immigrants is at least 140,000.
