EB-5 final action dates for India and China stay the same in April

The Department of State (DoS) released the April 2024 Visa Bulletin, which includes final action dates (Chart A) and filing dates (Chart B). Both dates have remained unchanged since February.

The final action date for employment-based immigrants, including EB-5 investors, is for filing green card applications. Until April, nationals from all countries except India and Mainland China can file their applications without backlog as their final action date remains current.

However, for Indian and Chinese EB-5 applicants, the final action date is Dec. 1, 2020, and Dec. 15, 2015, respectively. According to DoS, these dates will not change much before the 2024 fiscal year ends.

On the other hand, the filing dates remain Jan. 1, 207, for Mainland China and Apr. 1, 2022, for Indian nationals. An EB-5 investor can begin adjustment of status (AOS) by submitting form I-485 at a U.S. consulate abroad or in the U.S. after these dates.
