Most firms charge the retainer up front and bill against it hourly. Others approach it as a one time flat fee that you are not charged hourly going forward. Once the attorney fees are paid, The investor will provide the attorney with the information to prepare the form I526. Depending on the quality of the documents provided by the investor, this process can take anywhere from 2-6 weeks to complete. Once completed, the document is filed with CIS and a receipt will be generated by CIS and sent back to the attorney. The attorney must then wait until CIS either approves or denies the application, or sometimes they ask for additional information in the form of an RFE. Sometimes it can take CIS 12-18 months to respond to this. They have been trying to make this process quicker by streamlining processes on their side, but the processing time is still quite lengthy.
