The question of fees really depends on what role in the transaction will your lawyer fill. You''re making an investment where there will be risks inherent in making the investment and recovery of funds, and in expecting any income to be received during investment period. Is your lawyer to assist you in considering with you your rights and the regional center''s under the investor agreement and any limited liability partnership agreement. This work is often done by a lawyer you find before deciding on a particular EB-5 investment and continues until the final decision is made and the necessary funds are safely wired to the relevant escrow account for the investment and awaiting the filing of the visa. It is the practice of some regional centers to only permit their own selected attorneys file the necessary I-526 applications, so this needs to be determined before you go any further. We charge an hourly rate for work done in helping a client decide on his or her EB-5 investment and making all relevant checks, etc. The fees most lawyers charge for the work done in the filing of an EB-5 visa vary normally from $5,000 to 18,000 or more. Our firm charges $5,000 for work done in preparing and filing the I-526. Most lawyers will have a portion of such funds to be paid initially as a non-refundable retainer (which is treated as earned when received but refunded where in fact work is not done) and the balance is paid on the filing of the I-526. With regard to the responsibilities of the attorneys, this again depends on when you found them and what you negotiate with them. The lawyer who a regional center may require you to use for the filing of the forms is often representing the regional center and may not be the best advisor to discuss any potential issues with investing in that center. The lawyer''s letter of engagement or retainer agreement should spell out exactly what is to be done. Do note that the I-526 is only prepared after you have found the investment. You also should enquire as to whether consular interview advice might be included. Do note that these fees generally don''t include the work to be done in the filing of the I-829 petition which will need to be later needed to remove the two year conditional limitation of your green card.

Thus, while for ease of wire transfer and to reduce wire fee the attorney fees may be requested upfront, the funds are supposed to be in the client trust fund until the work has been performed at each step of the process.

The attorney should be able to handle the entire process including immigrant visa processing or adjustment of status. The attorney should handle the removal of condition in two years. The payment terms are negotiable, but most attorneys are paid a flat fee, upfront to handle the case. Progressive fee payments are sometimes made. The terms of any payment, as well as the scope of legal representation, i.e., which services the attorney will perform, should be contained in the retainer agreement/engagement agreement, which is a contract signed by the attorney and the client.

Thank you for the question. EB5 attorney fees range based on the firm. On average it costs $10,000-$15,000 for a firm to represent you and assist with your 526 application. Most firms charge the retainer up front and bill against it hourly. Others approach it as a one time flat fee that you are not charged hourly going forward. Once the attorney fees are paid, The investor will provide the attorney with the information to prepare the form I526. Depending on the quality of the documents provided by the investor, this process can take anywhere from 2-6 weeks to complete. Once completed, the document is filed with CIS and a receipt will be generated by CIS and sent back to the attorney. The attorney must then wait until CIS either approves or denies the application, or sometimes they ask for additional information in the form of an RFE. Sometimes it can take CIS 12-18 months to respond to this. They have been trying to make this process quicker by streamlining processes on their side, but the processing time is still quite lengthy. Once CIS makes a response, additional information is provided, if necessary and the application is either approved or denied. If approved, the investor will be allowed to come to the US as a conditional resident for a period of 6-12 months. Once the investor arrives in the US, the attorney will prepare an I 529 or request to remove the conditions and make the residency permanent and a green card will be issued to the investor if the 529 is approved. Some firms charge an additional fee for the 529 work, so just make sure to clarify this with the attorney. The attorney will always present you with a fee agreement that should break down how much they are charging you and what services the fees include.
