Key dates for EB-5 Unreserved investors remained unchanged in the November 2026 Visa Bulletin.
The Unreserved category generally covers investors ineligible for post-RIA reserved categories, and many petitioners who filed before the EB-5 Reform and Integrity Act of 2022 created those set-asides.
For Chinese investors, the filing date (Chart B) remains March 1, 2021. Eligible applicants in the United States with valid nonimmigrant status and earlier priority dates may file Form I-485, potentially beginning the adjustment-of-status process sooner and qualifying for employment authorization or advance parole while their applications are pending.
The Final Action Date (Chart A) for Chinese applicants remains Dec. 1, 2016. Those with earlier priority dates may qualify for final visa processing or adjustment-of-status approval, subject to other requirements. Consular visa issuance in China generally limits processing to applicants with earlier priority dates.
For Indian investors, the Final Action Date remains Dec. 1, 2023, and the filing date remains May 1, 2024. Eligible applicants in the United States with earlier priority dates may file for adjustment of status, subject to U.S. Citizenship and Immigration Services (USCIS) requirements.
Understanding filing and final action dates
These dates for other countries, as well as for the EB-5 Rural, High-Unemployment, and Infrastructure set-aside categories, also remained current for November.
Final Action Dates indicate when USCIS may approve an investor’s adjustment-of-status application or issue an immigrant visa. USCIS can adjudicate the underlying I-526E petition regardless of visa availability.
Meanwhile, filing dates determine when eligible investors may submit adjustment-of-status applications if USCIS authorizes the use of the Dates for Filing chart for that month.
