How do I find EB-5 investors?

I am looking for multiple investors for a large project in Tennessee. It is in the hospitality industry. What do I need to do as the person “looking” for the investors? How do I find these EB-5 investors?

It is difficult to find the right assistance for marketing an EB-5 project. If you are not working with an existing regional center that already has a presence in the market and marketing contacts (we are talking mainly about China, but there certainly are other markets out there), then it will be difficult. The first thing you will want to do is consult with one of the SEC professionals on eb5investors.com to make sure you understand what is allowed and what is required to market your investment, which is considered a security by the SEC. You don?t want to run afoul of any of those rules. Then, you can talk to immigration attorneys, regional centers and other entities (business plan writers, economists, etc.) in the EB-5 space and try to drum up interest (and potential investors) that way. It is not easy and it takes some time.

Are you the developer or are you a broker? Generally, developers use migration agents in foreign countries. You should be careful that you do not get embroiled in any broker-dealer issues. I would be happy to offer you a complimentary consult to discuss this matter further.

Retaining qualified and experienced EB-5 counsel, like our law firm, can be of great benefit to you, as such counsel will have experience working with immigration brokers and intermediaries. EB-5 counsel can also assist you with associating with an existing regional center that could also provide investor funding.

There is no one answer. While some projects utilize their connections others utilize finders. With the changes in the Reg D laws we will probably see creative ways to attract investors. Another good source of investors are often real brokers and wealth managers.

Our law firm will first represent you in reviewing and analyzing your EB-5 project compliance and marketability. Then we will introduce you to the intermediaries who have credible access to the foreign national investors. Due diligence will be performed by the intermediary and the foreign investors before they decide to fund the project.

You should consider entering into an agreement with a Broker/Dealer member of FINRA who has influence in foreign markets such as China. The BD will advise you on marketing and how to attract the investors you need.

There is an EB-5 marketing company, owned by individuals active in EB-5, that I can direct to you that helps to place the project with an agent in China, and the agent in China is responsible for finding the investors. The Chinese agents do not accept the project without knowing a great deal about it and that it is a good project. If you would like to discuss further, please schedule a conference call.
