EB-5 Regional Center Formation

Any commercial entity in the U.S. can apply for a license from USCIS to be a regional center and sponsor EB-5 investments. An owner of a regional center will first need to define the geographic scope of the regional center to be created, and then retain a professional team to prepare required legal, economic and corporate documents. These required documents will need to be submitted to USCIS via a Form I-924: Application For Regional Center Designation Under the Immigrant Investor Program. Broadly, the regional center petition must explain to USCIS how it will sponsor foreign investment in the U.S. by fostering job creation, how it will stay compliant with the EB-5 regulations, how it plans to manage its operational, marketing and promotional activities, and the geographic locations of its sponsored investments. If a regional center wants to change its designation, change organizational structures or seek exemplar approvals, another I-924 petition may need to be filed.
