When should the U.S. government renew the EB-5 visa program? - EB5Investors.com

When should the U.S. government renew the EB-5 visa program?

Is the renewal expected soon? Or will the U.S. government wait for the program to expire before renewing it with a law, as it did last time? Will current investors face a similar situation to the petitioners who have been waiting for approval since 2022?

The Regional Center Program is currently authorized through September 30,
2027. Congress has not set a timeline for extending it, so the timing
remains uncertain.

The 2022 law also protects regional-center petitions filed on or before
September 30, 2026, requiring USCIS to continue processing them even if the
program’s authorization expires. This means eligible investors who filed by
that date should not face a processing pause solely because of a lapse in
authorization.

For petitions filed after September 30, 2026, the program remains
authorized through September 30, 2027, but the same statutory protection
does not expressly apply. Congress may act before then, but investors
should follow legislative developments as the current authorization period
approaches its end.
