How much will the EB-5 program cost?

I am alone in United States and have all the documents required to apply for the EB-5 program. I would say I am a straight-forward case. How much will the total attorney fees will be from start: I-526 until removal of conditions on my green card (I-829)? What other costs should I be wary of? What is the general estimate of what I will have to spend?

    Attorney fees vary and different cost structures exist. I would suggest you call a few to get a range.

    Attorney costs vary depending upon the attorney''s experience and level of service. The USCIS filing fee for Form I-526 is $1,500. There are additional costs for either adjustment of status in the United States or immigrant visa processing at the U.S. embassy or consulate in your home country.

    The attorney fees depends on the EB-5 investment program you want to pursue; either investment with a regional center or direct investment in which you participate in the running of the business. Your attorney may have to do so many things in the process. Also, if you are married and your family members are included in your application, there can be additional costs. Overall, expect to spend between $12,000 and $45,000 by the time the conditions on your green card are removed (I-829). Advisably, don''t second guess your costs, talk to an EB-5 immigration attorney who can help you put the cost analysis together that will allow you to make an informed choice of what investment to pursue.

    You will probably spend between $15 thousand to $20 thousand in legal fees, plus related government filing fees. Each case is different, and if you consult with us or any immigration attorney in more detail, a better fee estimate and agreement can be established.

    Generally, you will be required to pay a regional center administrative fee (on average ranges between $30,000 to $55,000), USCIS filing fee (currently $1,500), attorney''s fees and costs (varies by an attorney, many EB-5 immigration attorneys charge a flat fee per a particular petition/application). Costs generally include translation of foreign documents (if any), postage expenses, etc. If your case is a direct EB-5 investment case, you will generally have no administrative fee charged by regional centers, but will have additional costs that may be associated with a preparation of a comprehensive business plan and other documents, fees charged by a broker, securities attorney, EB-5 immigration attorney, and related costs as above. It is highly recommended that you contact an EB-5 attorney to discuss the specifics of your case. Please do not hesitate to contact our office should you need more information.

    You may have to spend an additional $50,000 to $100,000 in fees to attorney''s immigration agents or brokers, and to the regional center and/or project in the form of administration fees. These fees will vary from investment to investment.

    You must choose an EB-5 immigration attorney to find out what they will charge to file your case. You will be required to pay the full investment (either $1,000,000 or $500,000), any administrative fee (if applying through a regional center), your EB-5 immigration attorney fee, and all U.S. government filing fees. For every step in your EB-5 case, you will be required to submit a filing fee and/or processing fee to the U.S. government.

    The question of attorney fees and costs should be answered between you and your potential attorney. After an initial consultation with the attorney, which I highly recommend, and after hearing all the facts and circumstances of your case, the attorney can make an informed decision of how to represent you. Hence, the actual fees can be accurately conveyed. Remember, you would not ask a doctor to determine fees and procedures without first an in-depth consultation.

    Each case is different, depending on complexity; whether you are investing in an already-established regional center or are doing your own project; source of funds issues; etc. I would venture that the AVERAGE fees for preparation and filing an I-526 run between $10,000-$20,000. It is substantially less for the removal of conditions two years later. Feel free to contact us to discuss your individual case.

    Attorney fees will vary based on the lawyer you select to file your petition. Most EB-5 attorneys charge a flat fee; however, some may choose to bill hourly. Other costs to keep in mind include translations, project administration fees and filing fees (to name a few).     There is no standard range. Depending on the complexity of your case, attorney fees may vary. Depending on whether you invest in a regional center EB-5 versus a direct EB-5, administrative fees may also vary. The admin fees generally range between $30-$55 thousand. There are also fees payable to USCIS for both the I-526 as well as the I-829 applications.
