How can I make EB-5 investment when there is a fund transfer limit in India?

I live in India and would like to invest through the EB-5 program. However, there is a $75,000 annual limit on transferring funds out of India, which is well below the $500,000 minimum EB-5 investment amount. How can I make an EB-5 investment if there is this annual limit on transferring funds out of India?

Please consult an experienced EB-5 attorney who is experienced with authentication and transfer of funds documentation. Generally, the easiest plan would be to have family and/or trusted friends help you overcome transfer limitations as long as the source of funds is lawful and originates from your personal bank account.

There may be options for you, but it would be wise to contact an experienced EB-5 immigration attorney who has represented Indian EB-5 investors in the past. There are some alternatives in showing the path of funds from you out of India to the EB-5 project/investment you choose.

We work with clients from countries with similar limits and are able to create approvable transfer plans. Please consult with an experienced EB-5 attorney who works with the authentication of funds.

Since the transfer amount is $75,000 per person per year, you could have relatives and friends help out in wiring. As long as the money started with you and through those angel helpers the EB-5 investment funds could be tracked dollar for dollar, it is a perfectly legal and acceptable method of transferring and investing in EB-5 projects. You just need to work with an experienced EB-5 attorney who is very detailed-oriented to carefully prepare source of funds document trails.

There is a $50,000 limit in China. They transfer the funds to 10 relatives or friends who then transfer the money for them.

You need to discuss with your migration agents and bankers on how to transfer the funds. This is something that cannot be handled from the United States.
