How do I know what stage my EB-5 visa application is in?

Will I know what stage my EB-5 Visa application is in? Will USCIS inform me as soon as my lawyer submits my application and notify me when my application was submitted?

    You should receive a recipient upon filing. Once you have a receipt number you can contact the USCIS or check online to determine the stage of your application

    Once you attorney files your I-526, your attorney will receive a Notice of Action in about 2-3 weeks indicating the date the case was received and the case number.     Once the I-526 is submitted to USCIS and receipted, a notice is issued by USCIS. That notice will provide a case number which can be used for tracking directly on the USCIS website. If you have not received a receipt notice you should contact the attorney who submitted your petition.

    USCIS normally will inform you and your lawyer. If you don''t receive USCIS letter, talk to your lawyer. You should have the tracking number to track your application.

    You can track the status of your I-526 and I-485 applications at USCIS''s official website, which is www.uscis.gov and input your receipt numbers. Or you can call USCIS''s hotline. If you go through a consular processing instead of filing an I-485 application, you cannot see the case status of your DS-230 application online.

    Once your lawyer has submitted the application and you receive a copy of the receipt notice, you could track online on the USCIS.GOV website with that receipt number if your attorney does not update you.

    Your attorney should notify you once your I-526 Petition has been filed. Also, the petition will be assign a receipt number, e.g WAC 13 123 45678, which can then be inputted on the USCIS website "Case Status Online" service to ascertain status.

    There are a few ways for you to know that you case has been filed. First, if your case is mailed via FedEx, you can track it with FedEx tracking number. Also, when your case is ready, your attorney will most likely ask you to write a check for $1,500 payable to Department of Home Land Security to be included with your petition. When that check is cashed, you will know that your package has been received. Also, if your attorney fills out an application to request electronic notification, you or your attorney will receive an email when your case is processed. Finally, when your case is processed, USCIS will be mailing your attorney and you receipt confirmation with confirmation number. With that confirmation number, you will be able to see processing updates of your case on USCIS webpage.

    Your lawyer will receive a Form I-797 receipt notice from USCIS. In the upper lefthand corner you will see a unique receipt number that you may use to consult "case status online" on the USCIS.gov website.

    Once your attorney submits an I-526 petition on your behalf, both your attorney and you will receive receipt notices form USCIS. The notice will contain your unique case number which you can use to check the status of your case online at uscis.gov by using case status tab. Presently, I-526 petitions take on average about 8-10 months to process. You should discuss this with your attorney.

    Thank you for your inquiry. Assuming your correct address listed on the petition, you should get the receipt notice (within the first few weeks after the filing) and a copy of the decision when it is made.
