How can my development in Miami become an EB-5 project?

How can my project receive approval for a development in downtown Miami? Should I create a regional center or turn it into a direct investment?

This question requires a lot more information to determine the viability of your project to become an EB5. However, without knowing anything about your project you can always lease a RC or set up your own. Happy to provide you with a free consult.

Lots of factors in this decision. I suggest a consult. For a private project there can be only one EB-5 investor.

If you want to be able to accept multiple investors, you need to become a regional center (or associate with one) and file a project approval application (Form I-965F) with USCIS before accepting any EB-5 investments.

To make your Miami development EB-5 eligible, you must first determine whether you want to proceed through the Direct EB-5 Program or the Regional Center Program. If your project can directly employ at least 10 U.S. workers per investor, a direct EB-5 structure may suffice. However, if job creation will include indirect or induced jobs (e.g., from construction or operational revenue), forming or affiliating with a USCIS-approved regional center is necessary. This involves submitting Form I-956 for regional center designation and Form I-956F for project approval before investors can file their I-526E petitions. Each option has different evidentiary and regulatory burdens, so consider consulting EB-5 counsel early in the process.
