Form I-140G, the Immigrant Petition for the Gold Card Program, is available for submission through the United States Citizenship and Immigration Service (USCIS) website, the latest development in the creation of the new visa program established by President Donald Trump through an Executive Order.
The form is a variation of Form I-140, which is required for immigrant petitions, and has previously received approval from the Office of Management and Budget (OMB).
This milestone was crucial to meeting the Dec. 18 program implementation deadline. However, the publication of the form does not mean the Gold Card program is officially implemented, as it still requires Congress’s approval.
“Publishing the form is not the finish line — it’s the starting gate,” says Bernard Wolfsdorf from WR Immigration. “The I-140G form is part of a broader package required under Executive Order 14351, which directs the relevant agencies to implement the Gold Card program.”
Wolfsdorf cautions that additional steps remain. “Notably, finalization of filing instructions and public release of procedures for submitting required donations and filing petitions. It does, however, appear that we are close in regards to the $1M Gold Card but still waiting for instructions on the $2 M Platinum Card.
Attorney Dennis Tristani from Tristani Law says that the dedicated form “confirms that the government is actively building the intake infrastructure, but the program remains in a pre-launch registration phase and is not yet open for direct filings.”
Charles Kuck of Kuck Baxter notes that there has been no publication of a proposed regulation for the Gold Card program, nor of the underlying basis for this form. “I suspect that there will be an immediate challenge to the legitimacy of this process if the APA is not followed. There is strong precedent requiring publication in the [Administrative Procedure Act] APA for immigration programs — DACA.”
How does the Form I-140G work to get a Gold Card?
The form outlines how USCIS will receive and process petitions under the new visa pathway.
To file Form I-140G, applicants must first register their information on trumpcard.gov and receive confirmation that their submission has been accepted. Only after receiving this notification can they create or log in to their USCIS online account to file the required form.
“USCIS will contact you when it is time to create or log in to your USCIS online account to file the Form I-140G,” says the agency website.
The cost to file Form I-140G is $15,000 per person, including the principal beneficiary, spouse, and any dependent children. Once the online account is established and the form is filed, applicants can use the messaging feature in the account to request assistance or clarification regarding their petition, further enhancing support throughout the application process.
Applicants must prove the lawful source of their investment funds, which must amount to at least $1 million (or $2 million for businesses). After approval, applicants must undergo consular processing for their visa.
The U.S. government revised the Gold Card program in September from its February announcement, highlighting its similarities to the EB-1A and EB-2 options.
