The average approval time for EB-5 projects linked to regional centers ranges from 5 to 3 months, based on the latest publicly available I-956F approvals.
Under the EB-5 Reform and Integrity Act of 2022 (RIA), regional centers are required to submit an I-956F form for each EB-5 project they manage. This important form provides the U.S. Citizenship and Immigration Services (USCIS) with key details about the project’s investment framework, job creation objectives, and whether it qualifies as a Targeted Employment Area (TEA), either urban or rural.
It is crucial that the I-956F form is submitted before any public offering of the project. Its approval confirms the project’s business strategy, outlines its job-creation plan, and assures prospective EB-5 investors that the regional center is committed to offering multiple investment options. EB-5 investors are encouraged to request a copy of the USCIS receipt notice from the regional center to verify if their project’s I-956F has been filed.
Moreover, since March 30, USCIS will review only investor petitions for projects with an approved I-956F.
