The State Department’s Visa Bulletin for February 2024 indicates that the final action date for Mainland Chinese EB-5 investors saw a slight advancement from Dec. 8, 2015, to Dec. 15, 2015.
However, the final action date for Indian EB-5 investors remains Dec. 1, 2020. This date for EB-5 investors from other countries besides China and India remains current, so they do not face any backlogs.
The State Department has explained that final action dates for EB-5 investors tend to advance when visa numbers become available for the following fiscal year. 2024 is expected to be favorable for EB-5 investors as more than 20,000 visas are projected to be available for this program.
Additionally, the dates for filing an EB-5 petition for Mainland Chinese and Indian applicants remain Jan. 1, 2017, and Apr. 1, 2022, respectively, as they have been since October 2023. Furthermore, for the new set-aside categories, all countries’ dates are current.
