I want to invest in/create my own business and apply for EB-5. How soon do I need to create the 10 jobs and for how long? Do I need to hire the 10 employees at the same time? Can I start with less than 10 employees and then increase the number over the next few years?

The investment must be sustained for the entire period. You could create the jobs all at once or over a period of months, as long as you end up with the required number of jobs. Your business plan (which is submitted at the I-526 stage, the initial stage of the process) will project the reasonable needs of the new commercial enterprise; it must include reasonable financial projections to show feasibility, and it must include a hiring timetable based upon credible and verifiable industry data. As long as the business plan complies and is credible, and you show that it is more likely than not that the jobs will be created and maintained at least until the condition is removed, then the case is approvable.
