How can I best show my EB-5 conditional permanent resident status for medical school when my status is expiring and so is the EB-5 program?

In 2018, I obtained my conditional permanent resident status as a dependent of an EB-5 petitioner. In 2020, our 2-year green card expired but our status has been extended with the I-797C form. In August, the 18-month period stated on I-797C form will be over, so I will be scheduling an InfoPass appointment in July.

I am currently in the process of applying to U.S. medical schools, and some schools are requiring me to send in a photo of my green card. In this case, how should I proceed? Furthermore, since my I-797C form will be “expiring” soon, will I have to update the schools with the I-551 stamp I will be receiving? What is the best way for me to show my status as a permanent resident to schools? I have been suggested including both the copy of the I-797C and a letter explaining my circumstances in the file, but I am not sure how I can explain my situation in the most concise way.

You are a permanent resident, and a conditional permanent resident is the same as a full permanent resident, so have your lawyer write a letter explaining this. Also, if the I-829 is delayed for an unreasonable period of time, you will likely succeed on a mandamus action.

Expired green card plus 18 months receipt should be enough. If outside the 18-month period, then also include a current I-551 stamp in your passport.

The EB-5 program lapse does not affect your I-829 petition. Your attorney can prepare a letter for the school. And yes, you will likely have to show I-551 stamps.
