How long does it usually take to prepare and file an I-526 petition for EB-5?

If my EB-5 funds are from a loan, and my documentation is ready to go and straightforward, how long should it take on average to prepare my I-526 petition?

Assuming all documentation is in order and you have finalized your investment/subscription process, the I-526 filing could be done in a week to 10 days.

What the investor thinks is a straightforward and simple case is not always the case when preparing the petition. How long it takes to prepare the documents and have them sign and file depends on each attorney; some could take months some could do it within a week, which our firm has done in the past, but I think about a month is a goof ballpark for preparing a comprehensive and approvable petition package together.

It depends on whether the project you are investing in also has all of their documents in order for filing. We can do these very efficiently if we have everything we need on the source of funds from you and from the project on their documents. Are you also filing for adjustment?

Typically the fastest cases can be done in a few days. Often, the level of documentation that an investor considers to be sufficient, may not meet the specific standards of the USCIS - so an experienced immigration attorney may recommend additional documentation in order to reduce the risks of an undesirable outcome. A week or so is more typical because the documents often need revisions and further support, and the lawyer works carefully with the client to construct the strongest available case.

It depends but generally no more than a week from the date all documents are ready. Most of us think that our documentation is ready to go and straightforward, and in reality, things are usually more complex. This is something you should discuss with your attorney so you can understand their process and manage your own expectations.
