Will the U.S. government reject my visa application if I’m from Venezuela?

I am Venezuelan born and raised, but I have been living in Brazil for more than 10 years because of my business. I have been looking at the H1-B visa and EB-5 visa options for a while now, I even looked at the possibility of studying an MBA in the U.S. to start my transition to living there, but now I am not so sure as to whether my application will be well received for either visa because of my nationality. Will the Trump government reject my application outright because I am from Venezuela even if I meet the conditions? Will my application review be more strict? What are my options now?

So far there is not any prohibition on Venezuelan filings. The government always has the option to look into your individual background for terrorist ties or criminal background, immigration violations etc.

You may not necessarily be denied an EB-5 visa simply because you are Venezuelan. Some Venezuelans may appear on the U.S. Department of Treasury’s Office of Foreign Assets Control (OFAC) list of "Specially Designated Nationals" or "SDNs”. Understanding each individual EB-5 investors source of funds will be important to consider to determine if you would face any issues. So, in short, you will not be denied outright simply because you are Venezuelan.

Every applicant for admission is deemed a future immigrant- thus, you will need to demonstrate it is likely you will depart the US at the end of your studies. Having good financial means and strong connections in a foreign country help towards that goal. Neither the H nor the EB-5 will be jeopardized because you are from Vz, but the student visa might be more difficult to get.
