Since the EB-5 category is not impacted by the executive order, could more visa numbers be allocated to the EB-5 category this year?

No, the government has neither any intention or any plan in progress to increase the number of EB-5 visas.

Visa allocation is a different beast and covered by the Department of State. While some EB-5 benefits were floated as a possible addition to the Covid stimulus bills (like additional visas) nothing came of it. Because of the lack of travel, you may see fewer people moving forward to take advantage of their approvals and visa availability.

Unfortunately, EB-5 does not get to use unused visas from other categories. The problem is with consulates closed, there is a fear that unless they reopen soon, many unused visas may get wasted. We are hopeful they will reopen soon and increase the number of interviews to make sure the full allocation is used before September 30 annual deadline.

No. By law, EB-5 is 7.1% of the worldwide level. If the worldwide level goes down, so does EB-5.
