Will I get a refund if I abandon my EB-5 application after filing the I-829?

I am waiting after filling out my I-829, and I have been married to my wife (a U.S. citizen) for 2 years. If I decide to file through my wife to get my green card and withdraw my I-829 (a very long waiting time), can I still receive my investment capital back?

Whether you get all or any part of your investment back depends on the project documents you signed at the time of investment or at a later date. We would be happy to help you with the process through your wife and work with you to abandon the EB-5 conditional residency at a suitable time.

You need to review the project documents you signed with the Regional Center to know what is possible.

The return of your capital is governed by the investment contract/PPM.

If your conditional green card has already expired, you can get your investment back, regardless of whether you withdraw I-829 or not. You need to discuss with the NCE about the terms of your funds return.
