I was arriving on an international flight with my dependent child (they are dependents in the I-526 filing but are now older than 25), and we failed to declare cash of around $30K-40K, which was seized. We were asked to fill out the CBP form and were let go. We are currently working on a case to prove the legitimacy of those funds. Does this affect the I-829 filing for me or my child? I filled out the CBP form in my name.

EB-5 Immigration attorneysIt should not, but we have to see the record since you clearly violated the law – it’s not about legitimacy it’s about the requirement to declare any amount over $10,000 when entering. The I-829 should be approvable, but you may have an issue if applying for naturalization later.
