Because of my parents’ health, I am thinking about returning to Vietnam for periods and waiting out the two years there until it’s time to apply for the last part of the process. But I am concerned that I may not be allowed longer than 3 months per year. What would be the best course of action?

Immigration attorneysAs a conditional permanent resident, you may apply for a re-entry permit.

Immigration attorneysSorry to hear that your parents are in poor health. However, it's possible to use that as the reason why you need to expedite your Advance Parole (Travel Permit) or to request an emergency/temporary one if their medical condition becomes critical. When filing a US based EB-5 visa application, you can include an Adjustment of Status (Residency/Green Card) and apply for Work and Travel Authorization documents. A client of ours just got their employment and travel authorization document approved 2 months (8 weeks) after filing it. He received the actual "combo card" in the mail today and filing date was 2/18/2025.
