I am looking at investment options for my EB-5 project. I am interested in partial payments, but I hear more and more about USCIS requesting additional information or rejecting applications involving partial payments. Why is that happening?

EB-5 Immigration attorneysNeed to be very careful with partial payments. USCIS is issuing straight denials on some cases. Technically, if you identify the funds and are in the process of investing it should be acceptable. But in reality, it’s no longer a safe. If you do partial funding, make sure you show you have all the funds available and are merely in process of transferring funds and best to make sure you fund immediately or at worst within 90 days. And if you choose a project without I-956F approval, be sure to maintain underlying nonimmigrant status.
