Why is the regional center offering a project without approval?

I am looking at different alternatives of EB-5 projects. But am also getting offers of projects without the I-956F approval ready. Some of them tell me they are in the process of obtaining the authorization. Is this legal? Should I just choose projects with their I-956 authorization already granted?

There are good projects that do not yet have 956F approval. We are getting 956F approvals within 4-5 months in some cases but each case must be evaluated on all the criteria.

I would only select a project with the I-956F approval.

I-956 and I956F are two very different things. An RC cannot offer a project if the RC has not itself been approved. Depending on the RC’s history, an I956 may or may not have to be approved prior to commencement of a project. An I956F relates to a project; this form’s approval is not necessary prior to project commencement BUT the Form must be properly FILED with the USCIS prior to any investor being able to file I526E.
You, as an investor, should have an attorney advising you about these matters.

If you have a choice, of course you should proceed with a project with I-956 approval for greater certainty, unless the other project without the I-956 approval seems more solid and appealing. I-956 approval is just one aspect that you should consider when selecting the projects. You should also consider the feasibility and prospect of the project itself and the regional center’s track record.
