I understand the two-year suspension period for the EB-5 investment. However, I do not know why it is taking between 4 and 5 years to get this part of the process if I have filed everything and the project is sound.

EB-5 Immigration attorneysThat sounds like too long. Have you done regular inquiries with USCIS Investor Center? You may want to consider federal litigation after attorney review.

EB-5 Immigration attorneysUnfortunately, this timeline for I-829 is accurate, and many I-829 cases (regardless of whether there are issues or not) are taking that long. Depending on how long exactly your case is pending and your personal circumstances, you may benefit from a Writ of Mandamus, which is a litigation in the U.S. Federal District Court to compel the USCIS to act on your case.

EB-5 Immigration attorneysIt is because of many accumulated pending I-829s. You may try to file a mandamus petition with a Federal District Court to request to compel USCIS to adjudicate your I-829 asap.

EB-5 Immigration attorneysGood morning,
USCIS processing times are approximate and are affected by many different factors among them is the number of pending cases versus the staff available to process them. This among other things creates the backlog you are experiencing.
