Why does my EB-5 case status not update online?

When I checked the status of my EB-5 case, I got a message from USCIS that the post office had returned the document to them. The USCIS said it would hold my document for 180 days and asked me to go to an e-request site to have the document resent. If an online request was not submitted shortly, they would destroy the document and I would need to file a new form I-526, Immigrant Petition by Alien Entrepreneur, with a fee. I finally did receive the receipt but why is the case status not updated online?

Sometimes there is a delay before updates are actually posted. Keep copies of all filings and submissions for this reason (in case you have to argue petitions were submitted before X date).

You should not expect accurate messages on the USCIS website. It has been my experience that they often have erroneous information. The best thing to do if you are worried is to call the customer service number listed on the receipt.

This has become fairly common. You can always contact the 1-800 customer service line to request updated status and also do a service request to have the status updated.

It is impossible to tell one why a case status has not been updated online except for the obvious answer = the entry of such data is an administrative/clerical function and either the USCIS is behind in entering the data or it is because of some oversight on the part of the USCIS.

USCIS website postings are not always accurate with the updates. The notice you speak of is usually the receipt that USCIS tries to mail out to the investor located overseas. Due to the inaccuracy of the postal delivery system, that receipt notice is often not delivered and returned. However, as long as your immigration attorney gets the attorney copy of the receipt, the case is not cancelled to have to be refiled. As long as you have the receipt notice, you should relax and do not worry about USCIS website updates for now, since it will take a long time for the case to be adjudicated. They will update it sooner or later.

It is common for the status to not be updated. You can email them and ask them to please update the website.
