Which court has jurisdiction over my EB-5 case?

My EB-5 petition on Form I-526 was filed at the California Service Center several years ago. My project and regional center are located in a different state, and I am currently living outside of the United States. In this case, to which court would I file a mandamus petition?

A Writ of Mandamus is filed with the U.S. District Court in D.C.

Your mandamus action should be filed in the USDC District of Columbia, where USCIS is located.

Should you wish to file a mandamus petition in a U.S. District Court, you would file it in the U.S. District Court that has jurisdiction. Your case is somewhat unusual, but most likely you would file where the project and regional center are located.

Most writs for mandamus are filed with the D.C. court where the IPO is and where your file was transferred.

You can file where you live since the defendant is the U.S. government.
