Where can an EB-5 regional center create the required jobs?

The EB-5 regional center jobs created must be created either directly by the job creating entity itself or indirectly based upon an economic impact report, which would have to be in the geographic area of the job creating entity and not in another state.

The safest method is to create the jobs within the designated geographic area; otherwise you can prolong a decision from USCIS.

It is the new commercial enterprise that must create the jobs. If the new commercial enterprise is principally doing business in a Targeted Employment Area, then any direct jobs should be created within a TEA. If the project is a regional center EB-5 project, any direct, indirect, or induced jobs should be created within the geographic scope of the regional center designation.

Both direct as well as indirect and induced jobs may be counted as stated in the I-526 petition and economic impact report. Please talk to your EB-5 immigration attorney and/or EB-5 economist.

The jobs must be created where the project is located. In essence, jobs must be in the area as stated in the I-526 petition, but certainly not in another state.

Jobs generally have to be created within the jurisdiction of the regional center, but depending on the economic impact report, it may be possible to include not only direct but also indirect jobs, so it may be possible to count these other jobs.

Indirect and induced jobs can be counted towards the New Commercial Enterprise's job creation estimates. Your immigration counsel, along with an experienced economist, will be able to determine the amount and location of jobs.
