I am an EB-5 investor. I need to get the I-551 stamp at a USCIS office in New York, but everyday the system shows “no appointment available.” Can I schedule an InfoPass appointment with a USCIS office in another state (e.g. California) to get the I-551 stamp?

As a result, make sure you are scheduled online before showing up at any of the U.S. Citizenship and Immigration Services (USCIS) offices. You should try the InfoPass appointment page (https://my.uscis.gov/appointment) during off-peak hours, such as after midnight or before 6 a.m. Sometimes, the dates will free up during those periods.

Typically you would get a temporary I-551 stamp showing that you are a lawful person of residency in the District Office of the USCIS who has jurisdiction of your case. You should go back in and try to make an InfoPass appointment at the earliest possible date, even if it is far in the future, as some appointment is better than no appointment at all. Getting an appointment in another state can be tricky and could only be done under a discretionary basis.

Since the EB-5 files are not kept in local offices and the officers access the online database, they are usually able to give you information/stamp your passport in any USCIS field office. Keep in mind that it is now possible to schedule InfoPass appointments at some U.S. consulates abroad, although we are experiencing some issues due to lack of training when it comes to stamping the passports, so this option should only be considered as a last resort.
