When will a decision be give after an I-485 interview?

I have received an I-829 denial. Simultaneously I attended an I-485 interview based on my marriage. At the interview, the officer provided me a white paper stating “your case is being held for review” and USCIS has all the documents from you. The officer did not have my A-file or information about my I-829 denial. He said he would have to consolidate both the files and will request my A-file from the office. How much time does this take to provide the final decision for my I-485 application from the date of interview?

There is no set time for USCIS to adjudicate an I-485 application, particularly one based on marriage to a citizen, after the interview. You should follow up with USCIS in 120 days if you do not hear anything before then. You can also call the USCIS Contact Center and make a service request on the status of your application.

Your case is in extended review and there is no timeline for such review. If you do not receive an update within 30 days, you should follow up. However, given the officer needs to pull your EB-5 file, my guess is that this will take a while.

We have seen them make decisions in a few days but there is no clock so it may be advisable to ask your lawyer to follow up.
