What will happen to my EB-5 application since my country is on the travel ban list?

I am from Nigeria, which was placed on the current travel ban. I would like to know if this ban affects an EB-5 application and if you have any advice before I submit my application in this situation?

There are several travel bans in force at the moment. Some impact EB-5 and some do not. And some are expected to be lifted by February. In any case, if you are only contemplating an application now, it will be at least 24 months before you are ready to pursue a visa based on such application. And a lot can change in 24 months.

It will not affect the I-526. It would affect the immigrant visa processing in the U.S. Consulate, but that will come several years after the I-526 filing, and by then (and perhaps soon into the next administration), it seems like the punitive travel bans may be lifted.

President-elect Joe Biden announced that he will revoke some of President Trump''s executive orders, which is expected to include the ban that affects Nigerians. If the ban gets revoked then it would have no negative impact on your application.

Currently, there is no ban on filing an I-526 petition or any other immigrant petition. Also, the EB-5 is not subject to any of the presidential proclamation visa/travel bans. If you are at the immigrant visa application stage, the fact that many U.S. embassies and consulates have not resumed "routine visa services" means that you may have difficulty or delay in getting an immigrant visa interview appointment, but if you are at the early stages of applying for EB-5, e.g. I-526 submission, none of this affects your case.

It means they cannot issue you the visa until Nigeria is no longer on the travel ban list.
