What to do if I’m getting divorced during the processing of my EB-5 I-829?

I was married when I filed for an EB-5 I-829 but I received an RFE. Now I’m getting a divorce and I plan on replying to USCIS. Is it ok for me to tell them that I’m getting divorced? What happens then? Do they automatically separate our application?

If you are the Principal, your application will continue; your divorced spouse will need to file his or her own I-829.

Divorce should not affect pending I-829. Ensure RFE is competently and timely responded by your immigration attorney.
