We went to the U.S. embassy in Hong Kong on Jan. 22 for an EB-5 visa interview as the letter from the national visa center (NVC) instructed us to. However, the security staff at the front door said they did not have my case at the embassy and didn’t let us in. As a result, we were unable to attend the interview. I called NVC again and they confirmed that my case is at the U.S. embassy in Hong Kong. What should I do now to complete my case?
Have your attorney contact the NVC and embassy immediately to resolve the problem.
Communicate with the consulate to reschedule. Most consulates have a website to do this.
You should contact both the NVC and the U.S. consulate to let them know of the error.
Normally, once the National Visa Center has received all the necessary information/documentation, they will notify the designated consulate in Hong Kong or otherwise, then the American consulate will schedule you for an interview. You would first be scheduled for your medical examination, and it would be unusual, once scheduled, that you not be admitted for the interview. You can either wait until the American consulate in Hong Kong schedules you for an interview or you can contact the American consulate online or in writing to ask if they've received your case and when you'll reschedule.
This could again be one of many unfortunate results of the government shutdown. They seem to be at a loss on what they should and should not do at various consulates and embassies around the world. You or your immigration attorney should get on the case and be in touch with the embassy in Hong Kong and explain that you are getting the run-around. You should certainly document your attempts to get your interview completed and that you are not being allowed to.
You should immediately contact the investment immigration attorney who originally represented you.
I'd want to see all correspondence from the NVC and consulate, all interview notices, etc. before contacting the NVC and consulate again to get it rescheduled.
You may need to contact the U.S. embassy in Hong Kong to clarify the situation and see if they can reschedule you. It may be because of the government shutdown at the moment, no visa interviews are being held, however.
