What options do I have if my CPR is expiring and I have not received my I-829 receipt?

We filed an I-829 petition on Nov.30 2020 but we have not received the receipt nor has the check been cashed. What options for follow up with USCIS are available? My CPR expires in February. What options do I have to continue working if the receipt is still not available?

Have you checked the shipping tracking information? Was your I-829 delivered successfully? If the I-829 was delivered, you can rule out the possibility of loss in the mail. As a result of COVID-19 restrictions, an increase in filings, current postal service volume and other external factors, you may experience a delay of four to six weeks in receiving your receipt notice after properly filing an application or petition with a USCIS lockbox. If you still have not received your I-829 receipt notice by the time your CPR expires, write to the email box of the IPO to inquire about the receipt.

Receipts are very slow these days, but I would expect it to come by February. If not cashed, you need to pursue with the Lockbox. Your attorney should know how to do this.

The issuance of receipts has been slow and delayed. If the receipt does not arrive in the days before expiration, I would consider refiling a duplicate with fee and explain the facts in the hope that you do not end up having to pay twice.

Many investors are in the same boat as you. Your attorney can write a letter to your employer, explain the law (i.e., extension of CPR status), and the situation with the LockBox and hope it works.

You continue to remain a conditional lawful permanent resident even if the USCIS fails to issue a receipt notice by the time your conditional residence period expires in February. Eventually, the USCIS will catch up on its backlog of cashing filing fee checks and issuing receipt notices. You should receive a notice extending your conditional status for 18 months. After that, if your I-829 is still pending, you are entitled to receive one-year extension stamps in your passport until a final decision is made.
