The cost to file a Writ depends on a number of issues you need to take into account. At minimum it will include the following: court filing fees, attorney fees and any additional fees your attorney may charge. Advisably, for a better and informed determination of these costs, consult an attorney who can help you file the Writ in California.

There is a court filing fee of a few hundred dollars to file the case, but the legal fees and payment structure for a mandamus case will vary depending upon the lawyer. Many lawyers will charge a flat fee to file the case and follow up with the AUSA and court as needed. If the case is settled, then that is the end of the legal fees. If they case goes further into additional services such as filing/responding to motions, preparing/responding to discovery requests, etc., there may be an additional hourly fee. Just like anything else, it is a good idea to get several estimates from immigration attorneys to compare pricing and also make sure to ask about their experience in filing such cases.

Legal services prices vary depending on the attorney. We try to accommodate client''s so we try to go as low as possible. The government filing fee is $400. Be cautious since USCIS I fighting many mandamus cases so be sure to hire a lawyer who will be ready to fight a motion to dismiss.
