What is the best way to apply for an E-2 visa renewal?

My E-2 visa is expiring in March 2021 and my I-94 I can stay till 2022. My initial E-2 visa was issued in Canada. What is best way to apply for an extension? Do I have to submit a new business plan or just report how my business is doing currently with tax reports and employee summaries?

You will need to show that you have complied with the EB-2 visa that was approved for you without material deviation. Typically, there is no need to file a new business plan but, you show compliance with your E-2 as it is now by producing detailed information on how your business is performing otherwise your renewal may be denied.

You do not need a visa renewal unless you plan to travel outside the U.S. if your I-94 is valid until 2022. If you do want to apply for the E-2 renewal and it is in Canada, it will be in Toronto. Lots of things are included in a visa renewal. We do not usually include a new business plan unless the direction of the business has changed substantially. The consulate website is also very specific on what they want and we use that a guideline.

If the tax reports and employee summaries show you made a substantial business that is not marginal and only supporting yourself and your family, then it should be sufficient to get your E-2 renewed at the U.S. consulate in Canada.

Depending on the consulate (you can check their E-2 renewal filing requirements online), you will likely have to demonstrate that your business is still active and operating in order to renew your E-2 visa. You probably do not need a new business plan, unless you have materially changed the business model. If you show company tax returns, business bank statements, company payroll records and sample contracts, invoices, receipts demonstrating continued business activity, you have a good chance of approval.

Most consulate instructions do not really have a list of documents for renewal. I like to include an update to the plan in an extension request.
