What happens to my EB-5 investment if my application is eventually denied?

If you wait more than four years for the approval of the EB-5 application and it is denied, and you live in the U.S., what happens to the money that was given to the regional center? If in those four years they never paid any dividend, is all this money lost? Legally, do they still have to return it?

You need to review the project documents you signed with the Regional Center or other project and may need to consult a litigator in the state of the project if they aren’t doing what was promised. Remember your funds needed to be at risk to qualify for the program. There may be redeployment options as well you should consider.
