There’s an issue with the serial number of the cheque I sent for my biometrics and the I-485 form we filed a few weeks ago. My bank just notified me of the situation. It may bounce once USCIS cashes it, although I am asking my bank for a solution. My attorney cautions we may need to file I-485 again. I’d like to know if this has happened before and how it was handled.

EB-5 Immigration attorneysIf the cheque is bounced, USCIS will return your entire package, and you need to re-submit it. The returned package means you never filed it. It may cause an overstaying issue. Because the underlying petition is EB-5, you are still ok if you re-file I-485 within 180 days after the expiration of your non-immigration status.

I doubt that you will need to refile. You or your attorney will likely receive a notice asking for payment to be resubmitted. It is important to submit the payment very quickly once that notice is received.
