What happens if an EB-5 investor cannot complete I-829 biometrics?

I am an EB-5 investor. My family was able to complete their biometrics, but due to travel issues I cannot. What will happen if I cannot complete my biometrics processing for my I-829 petition? How will my family's applications be affected?

You must reschedule your biometrics and appear at your local support center on a rescheduled date to take your biometrics. Generally, if you are the principal investor, your family's cases may be affected.

If you have not completed the biometric appointment, please remember to reschedule the appointment to a time convenient for you. No-show will result in a denial of your I-829 petition. Your family, if filed separately, may not be affected.

Initially your case alone will be denied if you miss and do not reschedule. But if you, the principal applicant, are denied, this could result in the other family member cases being denied and you can all be placed into deportation proceedings. You must reschedule and explain. Just appear at the Support Center and try and explain to them. Very important to take care of this ASAP.

Your process will be held up. I would make arrangements for another appointment for a date that you can do it.

They may be delayed, but generally the I-829 petitions are reviewed separately.

On the basis that you are the principal investor, you will have to complete the biometrics for the adjudication process and approval of the I-829 petition and your unconditional permanent residency. This has to occur first before your spouse and children receive their unconditional permanent residency.

You must reschedule the biometrics appointment for when you will be here to get this done. Biometrics is needed for security reasons so the application cannot be adjudicated without it. If you are the main applicant, then your family's case is dependent on yours.

You request to re-schedule your biometrics appointment. This will cause a delay in processing the I-829 for you and your family, since they cannot complete the file without the biometrics, but it is not fatal.

You should try to reschedule if you cannot make the appointment.
