I am interested in the EB-5 visa, but I just learned that the application deadline is in September this year. Am I still on time to do what’s needed?

EB-5 Immigration attorneysThe current expiration date of the EB-5 legislation is September 30, 2027. However, there is news that an extension is being sought. Thus, you will have plenty of time to file your I-526E petition. In terms of the September 30, 2026 date you mentioned, it is a date that protects you from the expiration of the current legislation. Thus, if the EB-5 legislation is not extended after September 30, 2027, you will be affected. Since there is bipartisan support for EB-5, I don't think this date really matters.

EB-5 Immigration attorneysNo, you are not too late. If you have the funds available to invest and can clearly document their lawful source, you are in a strong position. Several Regional Centers currently have projects that are accepting new investors. I can help guide you through the process and prepare and file your petition before September.

EB-5 Immigration attorneysYes, but you must act immediately. Most importantly, you must make your investment decision by selecting the most likely regional center project to invest in. That would be much faster than a direct EB-5 investment.

EB-5 Immigration attorneysAbsolutely. Certain types of programs often have ‘expiration dates’ and then are extended. But there are other types of EB5 projects that do not expire. In either case, you have enough time.
