I want to understand the risks of investing with a regional center for an EB-5 visa. I was reading about a regional center being sued because it was using the EB-5 capital it had raised for purposes other than the project it was raising. The investors learned about it when the lawsuit came out. This worries me a lot; my money being misused. Also, all the regional centers that were eliminated recently because they did not pay a fee. I would like to know how often these irregularities happen and how investors can protect themselves from this from the beginning?

EB-5 Immigration attorneysInvestors can protect themselves by working with a competent advisory team. Our office led the challenge of decertifying several regional centers for not paying the filing fee and we won. USCIS has reversed and now they can pay the Integrity fee.

EB-5 Immigration attorneysBest way to protect yourself is to invest in a known Regional Center with a solid immigration track record and/or retain a company to assist you with the due diligence on the Regional Center.

EB-5 Immigration attorneysThere are excellent regional centers that have never been sued by investors, projects or anyone else. And they pay their fees on time. And there are just as many decent EB-5 attorneys that will help you understand who you’re going into business with. Do your due diligence, don’t trust one/intermediary person just because they ask you to, and read what you’re signing.
