What are the requirements for an affidavit of support during the consular processing of an EB-5 application?

My I-526 petition, which included a $500,000 investment through a regional center, was approved in April and now I need to collect and submit my documents to the National Visa Center. Do I also need to send them an affidavit of support even though I am my own petitioner and I do not have a sponsor? If so, why? Also, what is the most common mistake when submitting these documents?

    You do not need an affidavit of support in this situation. You should have an immigration attorney involved with your immigration visa application and your immigrant visa interview.

    You do not need an affidavit of support for yourself. The most common mistake is to not use a qualified lawyer, because if you get this 99 percent right, you can get it denied. Make sure everything you submit is content with everything you have previously stated and, of course, make sure it is true.

    EB-5 investors are exempt from affidavit of support (Form I-864) requirement. You should submit project documentation with your NVC packet for your immigrant visa consular interview. Most regional centers do assist with providing a brief overview/summary of project and funds tracing to be included with your NVC packet.
