If I register my U.S.-born child for free health insurance, how could that impact our family’s EB-5 case?

I am an EB-5 investor but have not yet obtained a temporary green card. I plan to register my daughter who was born in the United States for free California Medi-Cal children’s health insurance. After registering her for the free children’s health insurance, will other family members become public charge for this reason when they file I-829 in the future? Will it affect the approval of our I-829? Or after I register her for this free children’s health insurance, will it have any impact on the immigration of my family members?

That should not affect the cases.

It will not have any effect on the applications of other family members under I-829.

USCIS is required to consider specific minimum factors in determining whether an applicant seeking admission is likely at any time to become a public charge. One of the statutory minimum factors is assets, resources, and financial status. If you are an EB-5 investor there is probably no question that you have sufficient assets to prevent relying on continuing public assistance to maintain health of yourself and family. If no financial minimum income is required for Cal Child health insurance, there should be no problem.

It won't impact your EB-5 case.
