How will USCIS treat my double nationality in my application?

I am Peruvian-Chilean, but have lived most of my life in Colombia. My Chilean nationality has allowed me entry into Europe without much issue. However, I plan to apply for the EB-5 visa and would like to know whether my dual nationality could pose any issues. Or having lived in Colombia for most of my adult life.

For adjudication purposes, USCIS or the Department of State will look at your country of birth. If your country of birth is a “paused” country and you have another nationality, they will consider that.

Dual nationality alone should have no effect on eligibility for an EB-5 visa. I recommend a consultation with an experienced EB-5 immigration attorney about your specific circumstances before proceeding.

There is no legal reason why you should be treated differently because of your nationality or residency.
