I am a Brazilian citizen applying for the EB-5 visa. Submitted the I-526 a month ago as principal, with my spouse and twins. But Syria was added recently to the travel ban, and all immigration procedures were paused for nationals from that country. My spouse is Syrian. How will that affect the processing of our application?

EB-5 Immigration attorneysThe petition will likely proceed normally although there may be more scrutiny-the chalge will come later when they start background checks, most likely.

EB-5 Immigration attorneysIt should not impact the adjudication of your I-526 petition, but would at best delay the issuance of your wife’s immigrant visa until the ban is lifted.

EB-5 Immigration attorneysUnfortunately, Syrian citizens are ineligible for issuance of any visas, including immigrant visas (green cards). If your spouse has dual citizenship and applies based on their other citizenship, there should be no issue. Otherwise, your spouse would need to request an exception from the ban.
