How can I track my I-526 process?

I got I-526 approval in January of last year. However, I have not received any further update from the National Visa Center. What is the current processing time for the NVC and for the consulate in Mumbai, India? How can I track my case further?

There is nothing unusual about the waiting period of this I-526 considering it is for an Indian national. In certain circumstances, I-526 can be under review for almost 18 months. Also, please note that each I-526 stands on its own merit; the processing time may be shorter for some and longer for others even when those I-526 petitioners are from the same country.

It appears something is wrong with the consular processing of your approved I-526 case. Generally, we receive an initial letter from the NVC with a case number and processing instructions within about 2 months of the case being forwarded from the USCIS. Contact your immigration attorney to sort it out for you or contact the NVC directly.

If you received approval in January 2016, then you need to contact the NVC. The NVC does not automatically receive your approval notice, except if that was specifically requested on the I-526 form. Normally, you would hear from NVC within about 2 months. At this point, you need to contact NVC yourself ASAP, otherwise, your case may be considered "abandoned." There is no additional wait time in India for the EB-5 program, so you should be able to process the immigrant visa as soon as you receive the approval.

Do you have an NVC case number? If you do not, there is a problem and this should be sorted out by their Research department, which can be reached at this email address NVCresearch@state.gov. Send them the I-526 approval number and a copy of the document.

You should ask your attorney to follow up with the National Visa Center (NVC). Usually, USCIS will forward information about approved I-526 to NVC in one month. NVC will then send a fee notice to your attorney. After you pay the fee, your attorney can file DS-260. There is no visa retrogression in India, so it is abnormal that you have not heard from NVC for this long.

It''s unusual that you have not heard back since you filed in January 2016. Once the NVC completes their paperwork and notifies the American Consulate in Mumbai, they can take several months or longer. You can go on the NVC website to determine the status of your case and to make an inquiry.

If your approval was in January of last year, something is wrong. It usually takes about 4-5 months to schedule an interview. Have you submitted all the requested information and the DS-260 form? I would suggest contacting the NVC ASAP.

Your attorney should call USCIS to check the progress of your case. If he/she sent the case to NVC, then he/she should call NVC to see why they haven''t issued the fee bill. While USCIS has been getting slower in sending approved case files to NVC, it has still been more than a year and that is unacceptable.
