I am an EB-5 investor currently awaiting the approval of my I-485 application. I hold an L-1B visa, which will expire in March 2026. My advance parole and EAD have been granted. If my I-485 is rejected, how much time do I have before I need to depart from the U.S.?

EB-5 Immigration attorneysIf you maintained your L visa and never used I-485-based EAD or travel document, you remain in L visa status. If your I-485 is denied and L visa is still valid, you can remain in the U.S. under that L visa. If you fail to maintain your L visa or use your I-485-based EAD for employment or travel document for international travel, you are no longer in L visa status. If your I-485 is denied, you will need to leave the U.S. immediately.
