My I-526 just got approved (September 2024). I already have an approved I-485/EAD and Advance Parole (since March 2024, based on the I-526 application). I also have been living in the U.S. on an L2S visa linked to my spouse’s L1A visa for the past 1.5 years. Will I get my conditional Green Card issued immediately? What are the next steps?

Find the Best EB5 Visa LawyersOnce your Form I-526 is approved, and you have an approved Form I-485, you are on the path to receiving your conditional green card. You will receive this in the mail. They usually take 2-3 weeks to arrive, but legally can take up to 90 days.
• Issuance of Conditional Green Card: If your I-485 is approved, you will receive a conditional green card valid for two years. This card allows you to live and work in the United States as a conditional permanent resident.
• Removal of Conditions: Before the expiration of your conditional green card, you must file Form I-829, Petition by Investor to Remove Conditions on Permanent Resident Status, to obtain a permanent green card. This petition must demonstrate that the investment was sustained and the required jobs were created.
• Current Status: While waiting for your conditional green card, you can continue to reside in the U.S. and use your EAD for employment. Your Advance Parole allows you to travel outside the U.S. and return without abandoning your adjustment of status application.

Find the Best EB5 Visa LawyersAdjustment adjudication has been haphazard. We got some cases approved but USCIS has slowed down in adjudication. We are pushing to get them to expedite these cases as its close to the end of the fiscal year.

Find the Best EB5 Visa LawyersIf you have the Welcome Notice for the I-485 it should come quickly. If the I-485 has not yet been adjudicated, then I would need more information to help with expected timing.

Find the Best EB5 Visa LawyersNo, you will not get anything immediately. There is no standard processing for I485s it seems. We’ve seen decisions in 6mo post I526 approval and 2 years and still waiting. You’ll need to sue if you want faster results.
