How should we attract Chinese investments?

We just got approved by USCIS to make a regional center. What is the best way to raise the EB-5 funds that we need for projects? Would it be better to find brokers/finders located in China, or to open our own office in China? Why?

In marketing to the Chinese market, pay particular attention to compliance to both U.S. and Chinese securities laws. Also, since one of the general goals of EB-5 visa program for investors is to get a green card, this will be one of your marketing themes to the investors. There are reputable brokers and finders in China, unless you prefer to open your own office, but always ensure that you are prepared to work with either of the two options. Consider the costs of setting up your own office, ability to operate in China and the need to comply with Chinese laws before you set up your office. Go slow at first. You should be wary of who you work with. Certainly there are many reputable Chinese agents/brokers/finders, but you need to do due diligence on who you will work with, to make sure they will follow the rules and work together with you, not against you.

Congratulations! Be wary of the SEC regulations S and D regarding broker/dealers and marketing to foreign markets. While it?s better from a control standpoint to keep it all in-house, working with an established, reputable firm in China will have the benefits of their established network and brand. Of course, you would definitely want qualified EB-5 counsel in the U.S. to represent your regional center and projects and review any work product of a Chinese broker (or to represent the investors outright).

The vast majority of Chinese investment through EB-5 programs is brokered through Chinese immigration agencies, which are organized on the provincial level. These agencies are heavily regulated under Chinese law due to decades of abuse. As a result, these agencies continue to suffer a very poor reputation in China. Nonetheless, they are the best, if not the exclusive, means of reaching Chinese investment. Therefore, no matter how foreign friendly your venture may seem, be prepared to deal with an intermediary.
